Applicability
These terms and conditions apply to all offers, orders, and agreements made through House Of Tourmaline. By placing an order, you agree to these terms and conditions. You can review and save them before completing your purchase.Any arrangements that differ from these terms are valid only if confirmed by us in writing or by email. Nothing in these terms and conditions limits your statutory rights as a consumer.
Our Jewelry
House Of Tourmaline primarily sells vintage and antique jewelry. These pieces have been previously worn and may show signs of wear consistent with their age and history. We describe and photograph our jewelry as accurately as possible. Measurements, weights, estimated dates, and gemstone carat weights may be approximate. Slight color variations may occur due to photography or screen settings. We carefully inspect our jewelry. Any known characteristics, visible signs of wear, or relevant alterations are disclosed in the product description where appropriate. Many of our pieces are one of a kind. Once a piece has been sold, it is generally no longer available. The vintage or antique nature of a piece does not affect your statutory rights if the product does not meet what you could reasonably expect.
Orders & Payment
A purchase agreement is concluded when we confirm your order. All prices are displayed in the selected currency. The applicable VAT treatment and any shipping costs are clearly stated before you complete your order.Payment is made using the payment methods available at checkout.Obvious errors, such as a clearly incorrect price, are not binding. If such an error occurs, we will contact you, and you may cancel your order free of charge. If a piece of jewelry unexpectedly becomes unavailable, we will inform you as soon as possible and refund any amount already paid in full. The jewelry remains our property until full payment has been received.
Shipping & Delivery
We carefully package and ship your order to the delivery address you provide. We offer free insured shipping with tracking for orders within the Netherlands and Belgium. For all other destinations, shipping costs are displayed at checkout before you finalize your order. The estimated delivery time is provided before completing your purchase. We will deliver your order within 30 days unless a different delivery period has been agreed upon. If delivery is delayed, we will contact you. You retain your statutory rights, including the right to cancel the agreement if delivery does not take place and the applicable legal requirements are met. We are responsible for the risk of loss or damage during shipping until you, or a person designated by you, have received the jewelry. This does not apply if you independently arrange a carrier that was not offered by us. Please inspect your order upon arrival. If anything is damaged or missing, contact us as soon as possible. Reporting an issue at a later stage does not affect your statutory rights.
International Orders
We ship internationally to the countries available at checkout.
For deliveries outside the European Union, import duties, local taxes, and customs clearance fees may apply. These costs are your responsibility unless we expressly state otherwise. Any import duties or taxes charged by foreign authorities are beyond our control. In the event of a return, these charges will not be refunded by House Of Tourmaline unless we are legally required to do so. Our agreements are governed by Dutch law. This does not affect any consumer protections you are entitled to under the applicable statutory consumer laws of your country of residence.
Returns & Right of Withdrawal
As a consumer, you have the right to withdraw from an online purchase within 14 days of receiving your order, without giving any reason.
The withdrawal period begins on the day after you, or a person designated by you, receive the jewelry. If an order is delivered in multiple shipments, the withdrawal period begins after receipt of the final item. If you wish to return a piece of jewelry, please email hello@houseoftourmaline.com within the withdrawal period, clearly stating that you wish to withdraw from your purchase. Please include your name and order number where possible. You may also use the statutory model withdrawal form, which is available separately on our website. Once you have notified us of your withdrawal, you have a further 14 days to return the jewelry. The direct costs of return shipping are your responsibility unless we have stated otherwise or are legally required to cover them. You may choose your own shipping carrier and are generally responsible for arranging a safe and proper return shipment. We strongly recommend using an insured shipping service with tracking. Please email us the name of the carrier and the tracking number. Failure to provide this information does not affect your statutory right of withdrawal. During the withdrawal period, the jewelry may only be carefully inspected and tried on, as would normally be permitted in a physical jewelry store. Actually wearing or using the jewelry goes beyond what is necessary to assess the item. House Of Tourmaline expects returned jewelry to be in the same condition in which it was received, except for what is necessary to inspect and try it on. If a piece of jewelry has been used beyond what is necessary for inspection, House Of Tourmaline may charge for any resulting reduction in value. This includes new signs of wear, damage, soiling, or other demonstrable consequences of wearing the jewelry that affect its value or resale potential. Any reduction in value will be assessed based on the condition of the jewelry and its impact on the item's value. Your statutory right of withdrawal remains unaffected. Please handle the jewelry with care and, where reasonably possible, return it with its original packaging and accompanying documents. House Of Tourmaline may inspect the condition of returned jewelry upon receipt and substantiate any reduction in value.
Refunds & Return Shipping Risk
If you withdraw from your entire order, we will refund the purchase price, including the original standard shipping costs, where applicable. Any additional costs resulting from a more expensive shipping method chosen by you will not be refunded.
We will issue your refund within 14 days of receiving your withdrawal notification. We may withhold the refund until we have physically received the jewelry or until you have provided evidence that it has been sent back, whichever occurs first. You are generally responsible for arranging return shipping and for the risk of loss or damage during the return shipment. If your chosen carrier fails to deliver the jewelry or damages it during transport, this may be at your expense and risk. We therefore strongly recommend using shipping insurance that covers the full value of the jewelry. This provision does not affect the statutory rules governing withdrawal and refunds. We carefully inspect returned jewelry for any damage or changes in condition. If the jewelry has decreased in value due to use beyond what is necessary for inspection, we may deduct the legally permitted reduction in value from your refund. Refunds will be issued using the same payment method used for the original purchase, unless we agree otherwise. No fees will be charged for the refund. If you return only part of an order, the original shipping costs will not automatically be refunded.
Altered & Personalized Jewelry
Some pieces of jewelry may be altered upon request, for example through engraving, design modifications, or other personalized adjustments. Jewelry made to your individual specifications or clearly personalized for you cannot be returned under the right of withdrawal, provided that the applicable statutory exception applies. We will inform you before purchase if the right of withdrawal is excluded for such an item.
Statutory Warranty & Jewelry Care
All jewelry sold by House Of Tourmaline is covered by statutory consumer warranty rights. You may reasonably expect the jewelry to match its description and be suitable for normal use, taking into account its age, condition, and nature. Vintage and antique jewelry may show natural wear, previous repairs, or signs of use. Where these characteristics have been clearly described before purchase, they form part of what you can reasonably expect from the item. If a piece of jewelry does not meet what you could reasonably expect, please email hello@houseoftourmaline.com. We will seek an appropriate solution in accordance with applicable law, such as repair, replacement where possible, a price reduction, or a refund. Damage resulting from improper use, accidents, inadequate care, or normal wear and tear is not considered a defect for which we are responsible, insofar as such damage cannot be attributed to us. We recommend wearing and caring for vintage and antique jewelry with particular attention. Some gemstones and settings are more delicate than those found in modern jewelry.
Complaints & Liability
If you have a complaint about a piece of jewelry or our service, please contact us at hello@houseoftourmaline.com. We aim to respond substantively as soon as possible and within 14 days. If we require more time, we will let you know. We are not liable for damage caused solely by improper use, inadequate care, or alterations made by third parties, insofar as such damage cannot be attributed to us. Nothing in these terms and conditions excludes or limits liability where such exclusion or limitation is prohibited by law.
Privacy, Governing Law & Amendments
We handle your personal information with care. Our separate Privacy Policy explains how we process personal data and what rights you have. The texts, photographs, and other content on our website are protected by intellectual property rights. Commercial use without our permission is prohibited unless otherwise permitted by law. All agreements with House Of Tourmaline are governed by Dutch law. As a consumer, you retain the protection of any laws in your country of residence that cannot legally be excluded under the applicable rules. We may amend these terms and conditions from time to time. The version in effect at the time you placed your order will apply to your purchase.
